The U.S. Department of Education is still working on drafting proposed regulations to update Section 504 of the Rehabilitation Act of 1973 for the first time in 46 years. The proposed rules were originally expected in August 2022, but have faced delays. Many educators, parents, and advocates hope the new regulations will clarify how Section 504 student accommodations align or differ from the rights of students with disabilities under the Individuals with Disabilities Education Act. However, the regulatory plans are likely still months away, as the Office of Management and Budget dashboard shows the Department of Education has not yet submitted the proposal for review.
